For the purposes of this policy, “Mishele,” “the Artist,” “the Studio,” “we,” “us” and “our” refer to Mishele and the studio or authorised representatives managing the artist’s work, website, archive, editions, communications and sales.

By accessing this website, viewing its content, purchasing an artwork or photographic edition, submitting an enquiry, downloading approved materials, or otherwise interacting with the website, you agree to respect the copyright, intellectual property and usage restrictions set out below.

Unless otherwise stated, all artworks, photographic works, moving-image works, performance documentation, installation documentation, still images, portraits, product images, edition images, texts, titles, series names, project descriptions, artist statements, biographies, curatorial texts, visual layouts, website design elements and other materials on this website are owned by or licensed to Mishele Doueihy.

All such materials are protected by copyright, moral rights, intellectual property laws, unfair competition laws, passing off laws, trademark laws and other applicable protections in relevant jurisdictions.

No content on this website is placed in the public domain. No rights are granted except those expressly stated in this policy or confirmed in writing by the Studio.

Collectors acquire the physical artwork or edition only, together with any specific rights expressly stated at the time of sale.
 

Unless otherwise agreed in writing, collectors may not reproduce, publish, scan, photograph for commercial use, sell reproductions of, license, mint, tokenise, alter, use in advertising, use in merchandise, or otherwise exploit the artwork or its image.

Photographic editions offered through the website or official Studio channels are authorised editions only when sold directly by Mishele, the Studio, an authorised gallery, an authorised edition partner, or another confirmed representative.
 

Any unauthorised print, poster, digital file, reproduction, NFT, token, merchandise item, derivative image, AI-generated imitation, altered copy or resale material using Mishele’s artworks, name, images or visual language is not an authorised artwork and may infringe the Artist’s rights.
 

Edition numbers, certificates of authenticity, invoices, artwork labels, documentation and provenance materials must not be copied, altered, falsified, removed, reproduced, resold separately, or used to imply authenticity for unauthorised works.

Without prior written permission from the Studio, you may not:
 

• Reproduce, copy, download, screenshot, scan or save artwork images or website content for republication.

• Publish, repost, distribute or circulate artwork images, texts or videos outside personal, private viewing.

• Use any content for commercial, promotional, advertising, editorial, institutional, educational, brand, product, merchandise, campaign or fundraising purposes.

• Modify, crop, colour-correct, filter, retouch, animate, collage, remix or create derivative works from any artwork, image, video, text or site content.

• Use any content on merchandise, apparel, posters, prints, publications, packaging, products, websites, social media campaigns, event materials or presentations without approval.

• Use Mishele’s name, artworks, likeness, biography, texts or visual materials in a way that suggests endorsement, collaboration, representation, sponsorship or affiliation.

• Sell, license, sublicense, assign, distribute or otherwise exploit any content from the website.

• Remove copyright notices, captions, credits, watermarks, metadata, edition details, copyright management information or attribution.

• Frame, embed, mirror, scrape, archive, crawl, index or copy substantial parts of the website.

• Use the website or its content to create confusingly similar artworks, visual identities, products, campaigns, websites or commercial materials.

• Use the Artist’s work in any unlawful, defamatory, misleading, hateful, exploitative, pornographic, violent, discriminatory or politically manipulative context.

• Use artworks, images, texts or visual material for artificial intelligence training, machine learning, dataset creation, synthetic media generation or automated extraction.

No artwork, image, moving-image work, text, product image, caption, metadata, webpage, archive material, edition detail or other content from this website may be scraped, harvested, extracted, indexed, copied, downloaded, cached, crawled or used for artificial intelligence training, machine learning, computer vision, image synthesis, generative AI, model development, dataset creation, style transfer, automated analysis or synthetic media generation without prior written permission from the Studio.
 

This restriction applies whether the material is used directly, indirectly, manually, automatically, commercially, non-commercially, privately, publicly, experimentally or as part of a larger dataset.
 

Any use of the Artist’s name, image, artworks, visual language, texts or documentation to generate, imitate, reproduce or approximate the Artist’s work through artificial intelligence systems is prohibited unless expressly authorised in writing.

Unless expressly announced through this website or an official Studio channel, no NFT, token, blockchain asset, digital collectible, smart contract, metaverse object, virtual artwork, digital edition or tokenised asset using Mishele’s name, likeness, artworks, images, texts, documentation, visual language or associated materials is authorised.
 

Any NFT, token or blockchain asset claiming to represent, derive from, reproduce or be associated with Mishele’s work without written authorisation is unauthorised.
 

The Studio reserves all rights in relation to digital editions, blockchain use, tokenisation, authentication systems and future digital distribution of the Artist’s work.

Press, media, curators, writers, institutions and publishers must request written permission before reproducing any artwork image, portrait, studio image, moving-image still, text, biography or other material from the website.
 

Approved press or editorial use must follow the terms provided by the Studio, including any required captions, credits, copyright notices, artwork details, image restrictions and publication limits.
 

Unless otherwise agreed in writing, approved press images may not be cropped, altered, filtered, overlaid with text, used as backgrounds, used in advertising, used in commercial campaigns, used on merchandise, sold, sublicensed, archived for future unrelated use, or transferred to third parties.
 

All approved press and editorial uses must credit the Artist and any photographer, gallery, institution, collaborator or rights holder as instructed by the Studio.

Requests to reproduce, license or publish any artwork image, moving-image still, text, portrait, archive material or website content must be submitted in writing through the Contact page or by email.
 

A reproduction request should include:

• Organisation, publication or institution.

• Artwork, image, series or text requested.

• Intended use.

• Format of use: print, digital, exhibition, film, broadcast, press, social media, academic, commercial or other.

• Territory.

• Duration.

• Print run, audience size or expected reach, if known.

• Any proposed captions, credits or surrounding text.

• Whether the use is commercial, editorial, educational, institutional or personal.
   

No use is approved unless the Studio provides written permission. Silence, receipt of a request, access to an image, previous communication, or public availability of the image on the website does not constitute permission.

Visitors may share links to public pages of this website.
 

Reposting artwork images from the website or official Studio channels may be permitted only where the repost is non-commercial, unaltered, properly credited, respectful of the artwork, and does not imply endorsement, representation, collaboration, sponsorship or affiliation.
 

The Studio may request removal of any repost, tag, story, reel, video, image, caption, profile use or social media content using Mishele’s work, name or image at any time and for any reason.

Social media sharing does not grant any copyright, licensing, publication, advertising, merchandising, reproduction or commercial rights.

Collectors may document an acquired artwork or edition for private collection records, insurance, framing, conservation, installation, estate, resale or archival purposes.
 

Collectors may not use artwork images, certificates, edition details or installation photographs for commercial, promotional, advertising, merchandising, licensing, publication, NFT, AI, product, brand or campaign purposes without prior written permission.
 

Where collectors wish to publish installation images, collection images or artwork images publicly, including on websites, social media, catalogues, press materials or resale platforms, they should contact the Studio for guidance on crediting, captioning and approved image use.

Private collector previews, pre-release materials, private viewing links, PDFs, price lists, edition information, artwork availability, installation proposals, unpublished images, studio notes, correspondence and related materials are confidential unless expressly marked otherwise.
 

Such materials may not be forwarded, published, screenshotted, copied, reproduced, uploaded, shared publicly, distributed to third parties, used commercially, or included in databases, press, presentations or AI systems without written permission from the Studio.
 

Access to a private preview does not grant reproduction rights, publication rights, acquisition rights, exclusivity, reservation of works, or permission to use the materials in any way beyond private review.

The names Mishele, mishele.art, related project titles, series titles, studio marks, logos, visual identifiers, exhibition titles, collection titles and other identifying elements may be protected by trademark, passing off, unfair competition or related laws.
 

You may not use these names or identifiers in a way that suggests endorsement, collaboration, authorship, representation, sponsorship, official status, commercial association or approval without written permission.

Mishele asserts all applicable moral rights, including the right to be identified as the author of the work and the right to object to derogatory, misleading, distorted or prejudicial treatment of the work.
 

Where permission is granted for publication or reproduction, all credits and captions must be used exactly as provided by the Studio.
 

Artwork images may not be altered, cropped, colour-shifted, filtered, reversed, animated, overlaid, recontextualised or combined with other materials unless expressly approved in writing.
